Terms of Service

These Terms are an agreement between you and Cap & Stem (“we,” “us”), which runs the Cap & Stem store at 814 S State St, Ann Arbor, MI 48104 and this website. By using the website, creating an account or placing an order, you agree to these Terms and to our Privacy Policy.

1. You must be 21 or older

You must be at least 21 years old to use this website, create an account or buy anything from us. We check a valid government-issued photo ID at the counter every time you pick up. If you can’t show valid ID, or you are under 21, we will not complete the sale.

2. Products and information

  1. Product descriptions, levels, potency and experience information are for general education only. They are not medical advice. Talk to a licensed healthcare provider before use, especially if you take medication, are pregnant or have a health condition.
  2. Effects vary from person to person. Do not drive or operate machinery after use.
  3. Photos are examples. Prices, availability and specials can change at any time.

3. Your account

  1. Give us accurate information and keep it up to date. One account per person.
  2. You are responsible for keeping your password private and for activity on your account.
  3. Your date of birth can be entered once. After that, only staff can change it, after checking your ID.
  4. We may suspend or close an account that breaks these Terms, gives false information or is used to buy for someone under 21.

4. Orders and pickup

  1. Online orders are requests to hold products for in-store pickup. An order is not a sale until you pay at the counter.
  2. We may cancel any order, for example if an item is out of stock, a price was wrong, or we can’t verify your age.
  3. Please pick up by closing time the day after you order. Unclaimed orders may be cancelled and the items returned to stock.
  4. You can cancel an order from your account before it is ready.
  5. Only the account holder may pick up an order, with matching photo ID.

5. Payment

  1. We accept cash only, paid in store. We never charge a card or account online.
  2. Any applicable taxes are shown at the register.
  3. Member discounts, store discounts, cashback and promotions are applied at the register.

6. Returns

All product sales are final unless the law requires otherwise. If a product is damaged or wrong when you pick it up, tell us before you leave the store.

7. Memberships

  1. Everyone with an account starts on the free plan. Paid plans are bought in store, with cash, one month at a time.
  2. Memberships are non-refundable, including for unused days. There is no grace period.
  3. A paid month runs through the “paid through” date shown on your account. If you don’t renew by then, your account moves to the free plan automatically.
  4. You can renew early; the new month starts the day after your current one ends.
  5. Upgrading mid-month: you pay the prorated price difference for the days left, and your paid-through date stays the same. You can’t move to a lower-priced plan until your paid month ends.
  6. You can request an upgrade online, but it only takes effect once you pay in store.
  7. We may change plan prices or benefits. Changes apply from your next renewal, not to a month you have already paid for.

8. Cashback, discounts and rewards

  1. Members earn cashback on the cash they pay for products, at their plan’s rate. Cashback isn’t earned on memberships or on purchases paid with cashback.
  2. Cashback can be spent at the register on products. It can’t be used for memberships, has no cash value, can’t be transferred and isn’t paid out if your account closes.
  3. If a sale is voided, cashback earned on it is removed and cashback spent on it is returned.
  4. First-visit discount: 20% off one purchase on your first visit to the store.
  5. Birthday reward: members on plans that include it get one discount, once per calendar year, on one purchase during their birthday month, in store. The birthday on file must match your ID.
  6. Store discounts (for example U of M, military and veterans, first responders) require proof at the register. One store discount per sale; it can be combined with your membership discount.
  7. We may change or end any discount or reward program. Cashback already earned stays usable for at least 30 days after notice.

9. Texts and emails

If you opt in, we may send account, order and promotional messages by email and, once texting launches, by text. Message and data rates may apply. You can opt out at any time in your account, or by replying STOP to a text. Opting out of promotions doesn’t stop order and account messages.

10. Your conduct

Don’t resell products, buy for anyone under 21, give false ID or information, misuse discounts or rewards, harass staff or customers, or try to break into or interfere with the website.

11. Disclaimers and limits of liability

  1. The website and products are provided “as is,” to the extent the law allows.
  2. You use products at your own risk and are responsible for following the laws that apply to you.
  3. To the extent the law allows, our total liability for any claim is limited to the amount you paid us for the product involved in the 12 months before the claim. We are not liable for indirect or consequential losses.
  4. You agree to indemnify us for claims caused by your breach of these Terms or misuse of products.

12. General

  1. Michigan law governs these Terms. Disputes go to the state or federal courts in Washtenaw County, Michigan.
  2. We may update these Terms. We’ll post the new date at the top and, for material changes, tell members by email.
  3. If part of these Terms can’t be enforced, the rest still applies.
